Terms & Conditions
Service agreement, warranty terms, payment terms, and consumer disclosures for Air Pro UT customers in Utah.
1Binding Agreement & Utah Governing Law
Welcome to Air Pro UT. By scheduling an appointment, requesting an estimate, authorizing on-site work, or using our website (https://www.airprout.com/), you ("Customer", "Property Owner", or "Client") agree to be legally bound by these Terms & Conditions.
Utah Choice of Law & Jurisdiction: These Terms and all service contracts executed by Air Pro UT shall be governed by, construed, and enforced strictly in accordance with the laws of the State of Utah, without giving effect to any principles of conflicts of law.
Any legal suit, action, or proceeding arising out of or related to our services or this agreement shall be instituted exclusively in the state or federal courts located in Salt Lake County, Utah. You irrevocably submit to the jurisdiction of such courts.
2Scope of Services & Site Access Obligations
Air Pro UT provides professional HVAC air duct cleaning, dryer vent clearance, chimney sweeping & inspection, air duct sealing, coil cleaning, blower motor servicing, and indoor air quality sanitization for residential and commercial properties.
Customer Property Obligations:
- Clear Work Area: Customer must ensure unobstructed access to all supply vents, return grilles, air handler units, furnaces, attics, roof exits, and chimney fireplaces prior to technician arrival.
- Pet & Safety Management: Customer agrees to keep all pets securely restrained during the entire duration of service to prevent escape or injury when doors/equipment are in use.
- Utilities: Customer must provide working electricity and clean running water at the service location necessary to operate high-powered negative air vacuums and rotary cleaning machinery.
- Property Authority: The person authorizing service represents and warrants that they are the legal property owner or an authorized agent with legal capacity to contract for property maintenance.
Utah Consumer Sales Practices Act Disclosures (Utah Code § 13-11)
In full compliance with Utah consumer protection laws, all final service pricing is presented clearly and authorized in writing or verbal consent prior to work commencement.
3Estimates, On-Site Inspection, & Pricing Approval
Preliminary Quotes: Estimates provided via telephone, email, or online scheduling forms are preliminary figures based solely on customer-provided details (such as approximate duct count or home square footage).
On-Site Physical Inspection: Before performing any work, our certified technicians conduct a physical inspection of your HVAC system, ductwork configuration, dryer exhaust run, or chimney flue.
Binding Final Price Authorization: The technician will present a clear, itemized final price before starting work. No additional services, sanitizing treatments, or component upgrades will be performed without your explicit prior authorization.
4Payment Terms & Statutory Utah Mechanics' Lien Notice
Payment Due Date: Payment is due in full immediately upon completion of services on the date of work, unless formal credit or commercial net terms have been agreed upon in writing.
Accepted Payment Methods: We accept major credit cards (Visa, MasterCard, Discover, American Express), debit cards, electronic bank transfers, cash, or pre-approved checks.
Invoices unpaid after 30 days shall accrue interest at a rate of 1.5% per month (18% per annum), or the maximum legal rate permissible under Utah law. In the event legal action or a collection agency is required to enforce payment, Customer agrees to pay all reasonable attorney's fees, court costs, and collection agency expenses incurred by Air Pro UT.
Under Utah law (Utah Construction Lien Statute, Utah Code Title 38, Chapter 1a), persons or companies performing labor or furnishing materials for the construction, alteration, or repair of any building, ductwork, or real property may record a mechanics' lien against the real property if they are not paid in full.
Failure to pay for contracted HVAC, air duct, or ventilation improvement work performed by Air Pro UT may result in the filing of a construction lien against your property in accordance with Utah state law.
5Cancellation Policy & Technician Field Dispatch Fee
We understand schedule changes happen. We respectfully request at least 24 hours advance notice for any appointment cancellations or rescheduling requests.
If our technician arrives at the designated service address during the agreed arrival window and is denied access to the property, or if the appointment is cancelled upon the technician's arrival without prior notice, a $50 field dispatch fee may be assessed to cover fuel and technician dispatch costs.
6Pre-Existing System & Property Conditions
While Air Pro UT technicians exercise extreme care and professional craftsmanship, air duct cleaning and chimney sweeping involve mechanical agitation inside existing infrastructure.
- System Age & Corrosion: Air Pro UT is not responsible for pre-existing structural damage, rusted HVAC coils, brittle or rotted flex ducting, improperly supported duct seams, dry-rotted dryer vents, or cracked chimney flue tiles installed prior to our arrival.
- Pre-Existing Mold & Water Intrusion: If active water leaks, heavy microbial infestation, or unsealed drywall returns are discovered during inspection, the technician will document the condition and notify the property owner immediately before proceeding.
- Documentation Protocol: Technicians take pre-work and post-work digital photos to record system condition for mutual quality assurance.

Good-Faith Informal Negotiation: Prior to initiating formal court litigation, Customer and Air Pro UT agree to attempt in good faith to resolve any service dispute through informal negotiations for a period of at least thirty (30) days following written notice of dispute.
Severability Clause: If any provision of these Terms is determined by a court of competent jurisdiction in Salt Lake County, Utah, to be invalid, illegal, or unenforceable, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.
